1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of thegiftcardmall.com (the “Site”), operated by TheGiftCardMall.com (“we”, “us”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. What the Site is

The Site publishes independent, general-interest information about prepaid gift cards for a United States audience. It is not affiliated with Gift Card Mall, Blackhawk Network, Visa, Mastercard or any card issuer, and it is not a financial service, a cardholder portal or a customer support channel. Our disclaimer forms part of these Terms and should be read alongside them.

3. No professional advice

Content on the Site is general information only. It is not financial, investment, legal, tax or accounting advice, and it does not take account of your circumstances. Your cardholder agreement and the terms published by your card issuer always govern your card. Consult a qualified professional before making decisions with financial consequences.

4. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorised access to the Site, its servers, or any connected system;
  • interfere with the Site's operation, including by denial-of-service or by introducing malicious code;
  • scrape, harvest or systematically extract content by automated means without our written permission, except that well-behaved search engine crawlers may index the Site in accordance with our robots.txt;
  • reproduce, republish or redistribute substantial portions of the Site's content without attribution and permission;
  • use the Site or our name to impersonate us, or to suggest an affiliation or endorsement that does not exist;
  • submit content that is unlawful, defamatory, abusive, deceptive or infringing, or that contains another person's confidential or financial data.

5. Your submissions

When you send us a message you confirm that you are entitled to share the information it contains and that it does not infringe anyone's rights. Do not send card numbers, PINs, security codes, bank credentials or other sensitive financial data. We do not want them, cannot act on them, and will delete any we receive.

By sending us feedback, a correction or a suggestion, you grant us a non-exclusive, royalty-free, perpetual licence to use it to improve the Site, without obligation or compensation. We will not publish your name or contact details without your permission.

6. Intellectual property

All original text, layout, graphics, code and other material on the Site is owned by TheGiftCardMall.com or its licensors and is protected by United States and international copyright law.

You may read, print and share individual pages for personal, non-commercial use, and you may quote short extracts with clear attribution and a link to the source page. Any other reproduction, adaptation or commercial use requires our prior written permission.

Third-party trademarks are the property of their owners and are used descriptively. See section 2 of our disclaimer.

The Site links to external websites we do not control. We provide those links for convenience and do not endorse or take responsibility for their content, accuracy, security or privacy practices. Your use of any linked site is at your own risk and subject to that site's terms.

8. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free, or that any information on it is complete, current or applicable to your situation.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THEGIFTCARDMALL.COM AND ITS OWNERS, OPERATORS AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF FUNDS, PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify and hold harmless TheGiftCardMall.com and its owners, operators and contributors from any claim, loss, liability or expense (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party right.

11. Availability and changes to the Site

We may modify, suspend or discontinue any part of the Site at any time without notice. We may also update these Terms; the date at the top of this page reflects the latest revision, and continued use after a change constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico and applicable United States federal law, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in New Mexico for any dispute not subject to another agreed process.

Before filing any claim, you agree to contact us at legal@thegiftcardmall.com and attempt to resolve the matter informally for at least 30 days.

13. General

If any provision of these Terms is found unenforceable, the remainder continues in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our privacy policy, cookie policy and disclaimer, are the entire agreement between you and us regarding the Site.
